Virginia Passes Bill To Give Electoral Votes To Popular Vote Winner

(Breitbart) – The Virginia House of Delegates has passed legislation seeking to award its electoral votes to whomever the wins the popular vote.

House Bill 177 passed with a 51-46 vote in the Democrat-majority House after being handed off by the Privileges and Elections Committee last week. Should the Senate also approve, Virginia will officially become part of the National Popular Vote Interstate Compact.

“Under the compact, Virginia agrees to award its electoral votes to the presidential ticket that receives the most popular votes in all 50 states and the District of Columbia,” a bill summary states. Further:

The compact goes into effect when states cumulatively possessing a majority of the electoral votes have joined the compact. A state may withdraw from the compact; however, a withdrawal occurring within six months of the end of a President’s term shall not become effective until a President or Vice President has qualified to serve the next term.

So far, 15 states, along with Washington D.C., have joined. The idea gained momentum as an answer to President Donald Trump’s electoral college victory over Hillary Clinton in 2016, despite her approximately three million popular vote lead.

Breitbart News Senior-Editor-at-Large Joel Pollak explained why many critics feel the popular vote could disenfranchise voters outside of major population centers, especially in a close election:

Under a national popular vote system, it would be possible for Nevada — or one of the other swing states — to vote for the candidate who lost the national popular vote, only to see its Electoral College votes awarded to the winner of the national popular vote. In a close election, that could elect a president — against the will of Nevada voters — who otherwise would have lost the election under the present system.

Moreover, the “national popular vote” would, critics say, reward candidates for concentrating their time and resources on the most densely populated parts of the country. It would also create an incentive for fraud in the jurisdictions most susceptible to it. California, with its new system of “ballot harvesting,” in which unregistered activists may deliver an unlimited number of mail-in ballots, would be a prime candidate, as rival campaigns competed to stuff ballot boxes.

Democrat Nevada Governor Steve Sisolak recently made a similar case when announcing his decision to veto the legislation. “Once effective, the National Popular Vote Interstate Compact could diminish the role of smaller states like Nevada in national electoral contests,” he said, “and force Nevada’s electors to side with whoever wins the nationwide popular vote, rather than the candidate Nevadans choose.”

“As Nevada’s governor, I am obligated to make such decisions according to my own conscience,” Sisolak concluded. “In cases like this, where Nevada’s interests could diverge from the interests of large states, I will always stand up for Nevada.”

    • You know how sometimes we’re just a little slow with our response time, well that’s me today! I have just come to the conclusion that Virginia’s governor is a complete nut job if he thinks he can just do anything he wants to do whenever he wants to do it.   1. Am I to understand they will award their electorial votes to the candidate who gets the most popular votes in their own state ? How is that different from the winner take all system which is currently in place ? If they mean to award their votes to the one who wins the popular vote nationally, which state starts counting first so the most popular candidate can be determined ? Also, how much of a margin would be needed to trigger a recount of every ballot in the entire country ?

  2. The Constitution’s Article I, Section 10 provides, in part, that “No State shall, without the Consent of Congress….enter into any agreement or Compact with another State.”

    So, don’t think that the voting compact is a done deal. It isn’t.

This isn’t just a law it is part of the Constitution which I thought had to be amended by Congress.   4. Unconstitutional. There is no such vote tally as a national popular vote. Each State’s voters vote for a slate of Electors chosen by the political parties. Your ballots are for those electors, not for a Presidential candidate. No federal agency tabulates and verifies a national total, it’s all done by third parties with no scrutiny. Each State’s decision stands alone and you no longer have 1 person one vote when your vote can be negated by what voters do elsewhere outside your state.

    • We may not have to worry about what’s constitutional or unconstitutional if Bloomberg would happen, which I don’t think he stands a chance in hell, but if he should happen to win, the very first thing he will do is do away with the 2nd Amendment and take all of our guns, but the illegals, dope dealers and gang members will still be able to get guns!   5. States are joining the National Popular Vote Interstate Compact, to give their citizens votes to the Democrats if they win the popular votes. HOWEVER, A state may withdraw from the compact; if a Republican candidate should win the popular vote. With open borders, no voter I.D., and felons voting we are sure to overcome the corrupt Republicans.

The statistics of the election of 2016 shows that Hillary only won 57 counties whereas Trump won 3084 counties. Should your vote count? In New York State, there are 62 counties, Hillary won 16 and Trump won 46. Should your vote count? In New York City, Hillary won the popular vote by winning 4 of 5 counties. Her popular vote advantage in NYC was 1.5 million votes. Should NYC elect the President, or should your vote count?

Now when the Electoral College puts someone in office that the people did not support there has throughout history been resentment from the people of this USA, now you can check political history and see this is a fact not something made up.

    • FRANK W BROWN,you are correct this legislation will not stand once it is challenged, It would require a Constitutional amendment that would have to be ratified by all 50 states, and it needs to be stopped now it seems that these state legislator and Governors have little to NO UNDERSTANDING of the Constitution and why this safeguard was put in place by our founding fathers. But that does not matter to the left all they are interested in is power and control.

      Now the Electoral College has only been effective 5 times in the History of this nation, so how can anyone say it has served this country well. The fact is in all five cases the person put in power by the Electoral College who did not win the popular vote has been put down by the American people, mainly because everything in this society is by majority vote, ans\d when the majority are cheated there is a price to pay.

This was a long fought argument between the states with some of the larger states arguing your point of view. The problem with a “majority of popular votes” does not address the fact of proper representation nation wide. you can not have large population states decide a National Election. The Electoral College gives proper participation and representation to all voters in all states

    Which is exactly WHY the Founding Fathers and framers of the Constitution put IN the Electoral College. Clinton won LA County, NYC and Cook County (Chicago), Ill by
    over 4.5 million votes. She LOST the rest of the country by over 1.5 million votes. I
    certainlyn don’t want LA, Chicago and NYC determining MY President.

  19. What a clever way to negate the votes of citizens. Electoral college votes are supposed to go to the winner of that State. If Virginia votes Republican and a Democrat receives more popular votes nationwide, the citizens of Virginia have their votes erased. This is not how our representative Republic is designed to function. Where is the ACLU on this obvious trampling of people’s voting rights? Judicial Watch will likely bring suit and hopefully it goes all the way to the SOTUS. AG Barr will likely have a say in it as well.

  21. It is illegal, and unconstitutional for the most populated states control who is the president. This leaves the smaller populated states votes to not count period. That is why the for father’s set it up the fairest way for all.

  22. First of all, there is no such thing as a popular vote. Secondly, they can’t counter the Constitution with their nonsensical law. Third, Article 10, Clause 3 of the Constitution forbids such agreements or compacts unless approved by both houses of Congress.
    No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.
    Virginia legislators just proved they are totally ignorant of the Constitution.

  24. This is the equivalent to ILLEGALLY ending the Electoral College, and must be stopped. This should be done by REQUIRING the state in question to Have the ELECTORS in question to VOTE the way the citizens elected, NOT go to the PARTY desired. This is the equivalent to “faithless electors” which the votes should be ANNULLED, the faithless voter go to PRISON for fraud, and a NEW voter take his place. This law should be STUCK DOWN by the SUPREME COURT as UNCONSTITUTIONAL. If the STATE refuses, then the votes should automatically go to who it was elected by the people (as apportioned by the Electoral College system), regardless of what the State electoral voter decrees.   25. I am a native Virginian. I do not agree with anything the “so called ” voted in representatives of the people are doing. The majority in the State House and Senate and in many local positions are democrats. Absolutely nothing that impacts the population of our State should be voted on by the elected officials. It is the responsibility and voice of each voter in the state of Virginia to determine decisions that affect all of us. This decision and that of gun laws should have and must be voted on by the citizens of the State of Virginia. Otherwise it is not a clear representation of our desires and rights.

  27. I am not so sure that this law will pass a Constitutional muster if challenged by the voters, To remove the ELECTORAL COLLEGE from elections would require a constitutional ammendment. This is all the result of Hillary being defeated in 2016, The Electoral College was never questioned until she lost, Its all about power and control. I really dont know if the Virginia voters are paying attention to what is happening in their state or if they just dont care, But they had better wake up
