(Gateway Pundit) – The Treasury Department on Tuesday missed a second Democrat deadline to provide President Trump’s tax returns.

Treasury Secretary Steve Mnuchin said the department cannot act on the request “unless and until it is determined to be consistent with law.”

Mnuchin said the department should provide the House Ways and Means Committee with a decision by May 6th, The Hill reported.

A couple weeks ago, the Treasury Department decided it would not turn over Trump’s tax returns by the April 10 deadline (the first deadline) set by Chairman Richard Neal on the Ways and Means Committee.

Treasury Secretary Steve Mnuchin previously that he will consult with the DOJ on the request.

“The Committee’s request raises serious issues concerning constitutional scope of Congressional investigative authority” Mnuchin previously said in his letter to Chairman Richard Neal (D-MA).

The Chairman of the House Ways and Means Committee, Rep. Richard Neal (D-MA), sent a letter to the IRS last Wednesday demanding President Trump’s tax returns for 2013 through 2018 as well as for several of Trump’s businesses.

“We’re under audit,” Trump told reporters a couple weeks ago. “Despite what people said and we’re working that out — I’m always under audit it seems — I’ve been under audit for many years because the numbers are big and guess when you have a name, you’re audited.”

“Until such time that I’m not under audit, I would not be inclined to do that,” Trump said.

Currently there is no law requiring a presidential candidate release their tax returns, but the Democrats don’t care about laws — they want to harass President Trump.

This legal battle over Trump’s taxes could find its way to the Supreme Court.
